Definitions:

• eBike: An electric bicycle equipped with a motor to assist with propulsion, which may include a battery, throttle, pedal-assist system, and other related electrical components.
• Related Equipment and Accessories: Includes but is not limited to helmets, locks, trailers, chargers, lights, and any other gear provided by the Company as part of the rental.
• Rider: The individual renting and operating an eBike, who agrees to abide by all terms and conditions outlined in this agreement. The rider must be at least 16 years of age.

Rental Agreement By signing this agreement, I ("Renter") acknowledge and agree to the following terms and conditions for renting an electric bike ("eBike") from Klinetics, Inc. and KlineRentNride ("Company").

1. 1. Assumption of Risk and Waiver of Liability
   • I understand that riding an eBike and the use of related equipment and accessories involves risks, including but not limited to accidents, injuries, and damages.
   • I voluntarily assume all risks associated with the use of the eBike and related equipment and accessories, and release Klinetics, Inc. and KlineRentNride, along with their owners, employees, and affiliates, from any liability for injuries, damages, or losses arising from my use of the eBike.
   • For myself, my heirs, executors, administrators, legal representatives, and successors in interest (collectively "successors"), I hereby waive, release, discharge, hold harmless, promise not to sue, and indemnify Klinetics, Inc. and KlineRentNride from any and all claims, liabilities, damages, or expenses arising from or related to my use of the eBike. 2. 2. Privacy Waiver
   • I acknowledge and consent to the collection of my location and usage data during the rental period for safety and operational purposes.
   • The Company may use this data for security, tracking, and maintenance purposes but agrees not to share personal information with third parties except as required by law.   Initial: _________
3. 3. Condition and Use of eBike
   • I agree to inspect the eBike and related equipment and accessories before use and confirm it is in good working condition.
   • I will follow all applicable traffic laws and safety guidelines while operating the eBike.
   • I will not use the eBike for any illegal activities, racing, or stunts.   Initial: _________
4. 4. Return Policy
   • I agree to return the eBike and related equipment and accessories to the designated return location by the agreed-upon time and in the same condition as received, normal wear and tear excepted.
   • Failure to return the eBike or related equipment and accessories on time may result in additional fees.
   • If the eBike or related equipment and accessories is lost, stolen, or damaged due to negligence, I accept full financial responsibility for repair or replacement. Initial: _________

1. 5. Limitation of Liability
   • Under no circumstances shall Klinetics, Inc. or KlineRentNride is to be held liable for any indirect, incidental, or consequential damages arising from the use of the eBike or related equipment and accessories.
   • I agree to indemnify and hold harmless the Company from any claims, demands, or lawsuits resulting from my rental and use of the eBike. Initial: _________
